Novinect Terms of Service
These Terms of Service apply specifically to Novinect, the WhatsApp automation SaaS and AI receptionist platform provided by Novic Technologies. By using Novinect, a business agrees to use the service responsibly and in compliance with Meta, WhatsApp, and applicable legal requirements.
1. Service Provider and Product
Novinect is provided by Novic Technologies. Novinect helps businesses coordinate WhatsApp customer communication through automation, AI-assisted responses, lead capture, staff dashboards, and human handoff features.
Novinect is not legal, compliance, financial, medical, or professional advice. Businesses remain responsible for their own legal and regulatory obligations.
2. Business Authorization
Each business is responsible for ensuring it has the right and authorization to connect its WhatsApp Business account, WhatsApp number, Meta Business assets, staff users, and customer communication workflows to Novinect.
Businesses are responsible for having a lawful basis, consent, or other required permission to message customers and process customer information through WhatsApp and Novinect.
3. Platform and Legal Compliance
Businesses using Novinect must comply with:
- Meta and WhatsApp Business Platform terms, policies, commerce rules, template rules, quality requirements, and messaging limits.
- Applicable privacy, consumer protection, electronic communication, marketing, anti-spam, and data protection laws.
- Customer privacy obligations, opt-in and opt-out rules, and any sector-specific restrictions that apply to the business.
4. Acceptable Use
Businesses must not use Novinect for:
- Spam, unauthorized marketing, deceptive messaging, phishing, fraud, impersonation, or illegal content.
- Harassment, hate, threats, exploitation, or content that violates Meta, WhatsApp, or applicable law.
- Sensitive regulated advice or decisions without appropriate professional review, including medical, legal, financial, immigration, or emergency advice.
- Trying to bypass WhatsApp limits, security controls, consent requirements, or customer privacy rights.
5. AI Responses and Human Monitoring
AI-generated replies may be incomplete, inaccurate, outdated, or inappropriate for a specific customer situation. Businesses should configure their Novinect knowledge base, review automation behavior, and monitor conversations regularly.
Human handoff and staff monitoring are recommended for bookings, payments, complaints, urgent issues, medical, legal, financial, or other sensitive situations. The business remains responsible for messages sent from its connected WhatsApp account.
6. Account Security
Businesses are responsible for managing dashboard users, staff access, passwords, device security, and account permissions. Novic Technologies should be notified promptly if a business suspects unauthorized access or misuse.
7. Payments and Subscriptions
If Novinect is provided under a paid plan, subscription, onboarding fee, usage fee, or custom service agreement, the business is responsible for paying agreed charges on time. Plan limits, payment schedules, renewal terms, and cancellation terms may be provided in a separate quote, invoice, or agreement.
8. Availability and Changes
Novic Technologies works to keep Novinect available and reliable, but the service may be interrupted by maintenance, updates, internet issues, third-party provider outages, Meta or WhatsApp platform changes, or security incidents.
We may update Novinect features, integrations, workflows, or requirements as the product evolves or as Meta and WhatsApp policies change.
9. Suspension or Termination
Novic Technologies may suspend or restrict access if a business uses Novinect for abuse, creates a security risk, fails to pay required fees, violates these Terms, violates Meta or WhatsApp policies, or exposes Novic Technologies, Meta, WhatsApp, customers, or other users to risk.
10. Data Handling
Novinect handles business, dashboard, connected WhatsApp, customer, message, lead, staff, AI setting, and technical log data as described in the Novinect Privacy Policy. Businesses should review that policy before connecting a WhatsApp account.
11. Limitation of Liability
To the maximum extent allowed by law, Novic Technologies is not liable for indirect, incidental, special, consequential, or punitive damages, lost profits, lost revenue, loss of data, customer disputes, platform enforcement actions, or business interruption arising from use of Novinect.
Novinect is provided for business operations support. Businesses remain responsible for their customer relationships, message content, compliance decisions, and use of the connected WhatsApp account.
